1. Introduction
Welcome to Lifed. These terms and conditions ("Terms") govern your use of the Lifed application and website (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
The Service is operated by Hot Mint Limited (company number 08152462), trading as Lifed, registered at 86-90 Paul Street, London, England, EC2A 4NE ("we", "us", "our").
2. Eligibility
You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this requirement and that all information you provide is accurate and complete.
3. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.
We use Clerk as our authentication provider. By creating an account, you also agree to Clerk's terms of service and privacy policy as they relate to account management and authentication.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to gain unauthorised access to any part of the Service, other accounts, or systems connected to the Service
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Upload or transmit any malicious code, viruses, or harmful data
- Use the Service to collect or harvest personal data of other users without their consent
- Reverse-engineer, decompile, or disassemble any part of the Service
5. Your data
You retain ownership of all data you submit to the Service ("Your Data"). By using the Service, you grant us a limited licence to store, process, and display Your Data solely for the purpose of providing the Service to you.
We will not sell, share, or otherwise distribute Your Data to third parties except as described in our Privacy policy or as required by law.
5.1 Open banking data
If you connect a bank account via our open banking integration, transaction data will be retrieved from your bank through our authorised provider. This data is processed in accordance with the Financial Conduct Authority's (FCA) regulations and our Privacy policy. You may disconnect your bank account at any time.
5.2 Health and fitness data
If you connect wearable devices or fitness trackers, health data will be retrieved through their respective APIs. This data is treated as sensitive personal data and handled with additional safeguards as described in our Privacy policy.
5.3 AI advisors
Our AI advisors process Your Data to provide personalised insights and guidance. AI-generated content is for informational purposes only and should not be treated as professional financial, medical, or legal advice. We do not guarantee the accuracy or completeness of AI-generated recommendations.
6. Intellectual property
The Service, including its design, features, code, and content (excluding Your Data), is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
7. Third-party services
The Service may integrate with third-party services (such as open banking providers, fitness tracker APIs, and authentication services). Your use of these integrations is subject to the respective third party's terms and conditions. We are not responsible for the availability, accuracy, or practices of third-party services.
8. Service availability
We aim to provide a reliable service but do not guarantee that the Service will be available at all times. We may suspend or discontinue the Service (or any part of it) at any time, with or without notice. We will make reasonable efforts to notify you of planned downtime.
9. Limitation of liability
To the fullest extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve months preceding the claim
- We are not liable for any loss or damage resulting from reliance on AI-generated content or recommendations
10. Termination
You may close your account at any time through the Service settings. Upon termination, we will delete Your Data in accordance with our Privacy policy and data retention schedule.
We may suspend or terminate your account if you breach these Terms, with or without notice.
11. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
